Services are performed at customer properties, and service availability may depend on location, project type, scheduling, permitting, site conditions, and other factors.

3. Services

DEM provides residential and commercial services that may include window installation or replacement, door installation or replacement, roofing, gutters, repairs, assessments, and related improvements. Website descriptions are general and do not guarantee that a particular service, material, product, schedule, price, permit, or result is available for every property.

4. Estimates, Proposals, and Separate Agreements

Website content and preliminary communications are for general informational purposes. A project is not accepted until DEM and the customer agree to the applicable written estimate, proposal, work order, contract, or other project document. The project-specific document controls the scope of work, materials, pricing, payment schedule, warranties, exclusions, change orders, and other project terms. If these Terms conflict with a signed project-specific agreement, the signed project-specific agreement controls for that project.

5. Customer Responsibilities

When requesting or receiving Services, you agree to:

Provide accurate contact, property, access, ownership, and project information.

Have authority to request work at the property or obtain the property owner’s authorization.

Provide safe and reasonable access to the work area at the scheduled time.

Disclose known hazards, restrictions, association requirements, or property conditions that may affect the work.

Review and comply with the payment, access, preparation, care, and maintenance requirements stated in the project-specific agreement.

6. Payment Terms and Financing

Payment amounts, deposits, progress payments, final payments, accepted payment methods, and late-payment terms are stated in the applicable estimate, proposal, invoice, or contract. Unless otherwise specified in writing, payment is due upon completion of the applicable Service. Financing, when offered, may be provided by an independent third party and is subject to that provider’s approval, disclosures, rates, fees, and separate terms. DEM does not guarantee financing approval.

7. Booking and Cancellation Policy

Services or appointments may be requested through the website, by telephone, or by email. Cancellations or rescheduling requests must be made at least 24 clock-hours before the scheduled appointment or Service. Failure to cancel or reschedule within this period may result in a cancellation, trip, restocking, or other reasonable fee when permitted by the applicable project agreement and law.

8. Refund Policy

Refund requests are evaluated on a case-by-case basis and may be subject to the applicable proposal, contract, product order, manufacturer terms, completed work, and law. If you are dissatisfied with a Service, contact us at dem@windowsanddoorsnashville.com or 615-496-0103 within 7 days of the Service date so we can review your concern. This policy does not limit any non-waivable rights or remedies available under applicable law.

9. Changes, Delays, and Site Conditions

Project schedules and costs may be affected by weather, inspections, permits, supplier availability, concealed damage, structural conditions, customer-requested changes, access limitations, utility issues, or other circumstances beyond initial assumptions. Changes to scope, price, materials, or schedule may require a written change order or revised agreement.

10. Products and Warranties

Product specifications, colors, images, and descriptions may vary from actual products. Manufacturer warranties are provided by the applicable manufacturer and are subject to their terms. Any DEM workmanship warranty must be stated in a written project-specific agreement. Except as expressly stated in a written agreement or required by law, website content does not create a warranty.

11. Intellectual Property

Unless otherwise stated, the website and its text, graphics, logos, photographs, videos, design, and other content are owned by or licensed to DEM Windows & Doors and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial purposes only.

ANY LIABILITY RELATING TO CONTRACTED SERVICES IS GOVERNED BY THE APPLICABLE PROJECT-SPECIFIC AGREEMENT AND LAW. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold DEM and its owners, employees, contractors, and agents harmless from claims, liabilities, losses, damages, and expenses arising from your unlawful misuse of the website, your violation of these Terms, or content you submit. This section does not apply to the extent a claim results from DEM’s own conduct or where indemnification is prohibited by law.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Unless applicable law or a project-specific agreement requires otherwise, disputes relating solely to the website or these Terms will be brought in the state or federal courts with jurisdiction in Davidson County, Tennessee.

20. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

21. Changes to These Terms
